日本人と外国人の離婚ではどちらの国の法律となるか

日本人と外国人の離婚の場合、どの国の法律が適用されるかは非常に重要な問題です。一般的には、国際離婚の取り決めには「法律適用に関する通則法」と呼ばれる法律が用いられます。基本的には、次のような順序で適用される法律が決まります。

DIVORCE AGREEMENT

This Divorce Agreement (“Agreement”) is made and entered into by and between [Name of Spouse 1] (hereinafter referred to as “Spouse 1”) and [Name of Spouse 2] (hereinafter referred to as “Spouse 2”) (collectively, the “Parties”), effective as of [Effective Date].
